So you’ve been served! Now what?
Below are the timelines for defending a civil action in a Nova Scotia
court. Of course, if you utilize the services of Promediate
Business Solutions soon enough, we can usually settle the matter out of
court...no defence needed.
Filing
Deadlines Changed
The deadlines for filing a defence have changed slightly for actions
filed after January 1, 2009. For service in Nova Scotia, the 15 day
deadline amounts to three full weeks, 30 days to six weeks, and 45 days
to 9 full weeks, not including holidays. For actions filed before
January 1, 2009, the previous Rules continue to govern the notice
period for giving notice of an action to a person, and motions for
default judgment (R.92.05).

Your Company
Has A Credit Report Too!
When
your cheques don’t clear your bank or you are behind in payments to
your suppliers don’t be so naive to think it goes unnoticed.
Just as
there are consumer credit bureaus there are also commercial credit
bureaus that track your payment history, nsf cheques, collections and
legal actions. There are many commercial credit reporting
bureaus in
Canada but these are the main ones if you are located in the Maritime
Provinces. It probably wouldn’t be a bad idea to scope out
your
company’s credit report for accuracy. Also make sure that if
you do
get sued or placed into collection, make sure the bureau report is
updated when you finish paying it off.
